Practical Considerations
As we return from spring break and enter the last part of the school year, it is important for staff to keep in mind student discipline policies and procedures. Generally, no student may be suspended more than twenty (20) school days in an academic school year. There are additional protections for students with disabilities who have an IEP or Section 504 plan. This includes those students for whom a district had a "basis of knowledge" prior to the conduct resulting discipline that the student may have a disability. In such instances, school districts need to hold a manifestation determination meeting within 10 school days of the decision to change the student's placement. A student’s placement is changed with a recommendation for expulsion is made, or when the student has been suspended in excess of 10 school days.
